The Constitution of Caer Sidi as currently in force.



Preamble: We, the Seasonal Monarchy, Interior Council, and the collective citizens of the region of Caer Sidi, understanding that a strong foundation and structure for our government is paramount to our success and having a commitment to creating an inclusive and welcoming region, do hereby adopt this constitution as our own and pledge to follow the rights and procedures set out within.



I. The Monarchy


Section A. The Establishment of The Monarchy

A Constitutional Monarchy shall be established in Caer Sidi.

§1. The Head of State of Caer Sidi shall be known as the Seasonal Monarch, who shall reign over the region until succeeded by their legally appointed heir.

§2. The Seasonal Monarch shall be known as The Monarchy.

§3. The Seasonal Monarch may be addressed as the Seasonal Queen or Seasonal King if they so choose.


Section B. The Powers of the Monarchy

The Monarchy reign as the Head of State and the Judiciary of Caer Sidi. The Monarchy is invested with the following Royal Powers of the region:

§1. The Monarchy shall have the power to appoint and dismiss members from The Interior Council.

§2. The Monarchy shall have the power to start impeachment proceedings for any member of government.

§3. The Monarchy shall have the power to address the Oireachtas at the opening of each Orator-ial term.

§4. The Monarchy shall have the power to appoint or dismiss the head of military operations.

§5. The Monarchy shall have the power to grant or refuse Assent on all Acts of The Oireachtas, though refusal may be overturned by a supermajority vote.

§6a. The Monarchy shall have the power to grant or refuse Assent on all Constitutional Amendments, though refusal may be overturned by a supermajority.

§6b.Refusal of assent on any Constitutional Amendment that seeks to do the following cannot be overturned;

(i) Dissolve the Monarchy;
(ii) Remove the Head of State or Legal Heir(s) to the Monarchy;
(iii) Limit the inherent rights of any citizens as laid out in this constitution;
(iv) Limit the power of the Monarchy.

§7. The Monarchy shall have the power to dismiss the World Assembly Delegate of Caer Sidi.

§8. The Monarchy shall have the power to grant and remove honors of knighthood upon citizens of Caer Sidi.

§9. The Monarchy shall have the power to legislate and amend the constitution through Royal Decree. All Royal Decrees take effect immediately, but must receive a simple majority vote from the Oireachtas within 7 days in order to be recognized as law after 7 days..


Section C. Succession of the Monarchy

The Monarchy shall be succeeded upon retirement by their legally appointed heir.

§1. The Monarchy shall establish an order of royal succession.

§2. The Monarchy may appoint or alter the order of succession at any time.

§3. The Monarchy must make an official announcement upon altering the order of succession.



II. Regency


Section A. Appointment of Regents

§1. A Regent may be appointed at the Monarchy’s discretion in order to provide support in governance.

§2. There may only be one appointed Regent at any given time.

§3. Regent appointments must be ratified by House Roayl with a simple majority in order to pass.


Section B. Regent Power and Responsibilities

§1. The Regent shall be responsible for:

(i) Providing assistance in tasks such as new citizen acceptance and citizenship audits;
(ii) Providing counsel to the Monarch during times of difficulty.


III. Citizenship


Section A. Defining Citizenship

Citizens shall be defined as members who:

§1. Have a nation in the NationStates region of Caer Sidi and,

§2. Have applied and been accepted for citizenship on the offsite forums.


Section B. Inherent Rights

Citizens shall have inherent, unalienable rights within the region of Caer Sidi.

§1. All citizens shall have the right to vote.

§2. All citizens shall have the right to run for office.

§3. All citizens shall have the right to protection from harassment.

§4. All citizens shall have the right to protection from hate speech and discrimination.

a. Hate speech and discrimination shall be defined as speech that attacks or infringes upon the rights of a person or group on the basis of attributes including but not limited to; race, religion, ethnic origin, sexual orientation, disability, sex, gender, or gender identity.


Section C. Citizen Responsibilities

§1. Citizens shall be responsible for following all regional laws and codes of Caer Sidi.

§2. Citizens have a responsibility to vote in general elections, participate in the Oireachtas, contribute to the Regional Message Board, volunteer for community positions and generally keep Caer Sidi an active and engaged region.


Section D. Citizen Applications and Diplomatic Visas

§1. The Taoiseach and the Monarchy shall have the ability to accept or deny citizenship and diplomatic applications.


§2. The Foreign Affairs Minister shall have the right, along with the Taoiseach and Monarchy, to accept or deny diplomatic visas.



IV. The Oireachtas


Section A. The Structure of the Oireachtas

§1. The Oireachtas shall be the legislative body of Caer Sidi.

§2. The House of the Oireachtas is known as House Roayl.

§3. The Oireachtas shall be comprised of all citizens of the region.

§4. The Oireachtas will be led by the Orator.

§5. The Orator may at their discretion, appoint a Deputy Orator to help them in their duties.


Section B. The Duties of the Oireachtas

The Oireachtas shall be responsible for drafting, debating and voting on legislative drafts, legal appointments under constitutional jurisdiction, and treaty ratifications.


Section C. The Procedure of the Oireachtas

The procedures of the Houses of the Oireachtas shall be outlined in other acts.



Section D. Debate

§1. Debate must be open for a minimum of 48 hours.

§2.During debate, members of the House may propose amendments to the bill at hand at any time.

§3. Citizens may speak in the House discussion provided they are serious about the topic, and do not cause distraction or spam the floor.

§4. The Orator reserves the right to revoke a citizen's participation in the House if they are spamming or otherwise distracting.

§5. Debate may end at any time after the 48 hour period by a Motion to close debate.



V. Legislation Amendments

§1. All members may propose and discuss changes to a document.

§2. Legislation may be amended if a majority of members agree to a specific change.

§3. The Monarchy and guests may suggest changes, but shall not be considered with the finality or powers of members of the House.



VI. Voting

§1. Voting on legislation will open immediately following a motion to close debate.

§2. Voting will remain open 48 hours or until all members have voted.

§3. Laws requires a simple majority of members to pass; Constitutional Amendments a super-majority.

§4. Should a bill fail, the legislation may not be proposed again for a period of one week.

§5. Members shall have the right to abstain. In the event of abstention, the total vote count shall be reduced by one vote and majority thresholds adjusted.



VII. Decorum

§1. All debate, voting, and interpersonal interactions of the members of the House must be conducted with respect and good faith.



VIII. The Orator of the Oireachtas

The Orator shall preside over the daily operations of the Oireachtas, ensuring that procedure is followed and any issue that arises may be dealt with fairly.

§1. The Orator shall be elected from the voting members of the House by a simple majority.

§2. Orator elections shall last 48 hours.

§3. Should 48 hours pass without an election, the Monarchy shall appoint an orator from the voting members of the Oireachtas.

§4. The Orator shall have the power to table legislative proposals with a simple majority vote.

§5. When appropriate; The Orator shall make a monthly overview detailing current debates, vote counts, and updating the legislative agenda for the term.



Section E. Impeachment

The Orator shall be held accountable as a representatives of Caer Sidi.

§1. Any Orator who does not log into the forums for a period of 7 days without being on Leave of Absence may be subject to impeachment.



IX. Interior Council


Section A. Appointments to the Interior Council

The Interior Council shall be the out of character administration of the region, and work with the Monarchy to maintain the day to day operations of the forums and the Discord.

§1. The Interior Council shall be appointed by The Monarchy.


Section B. Responsibilities of the Interior Council

The Interior Council shall have the power to:

§1. Moderate and perform general administrative duties, including but not limited to;

(a) The processing of citizenship, diplomatic and holdfast applications;

(b) The creation of new subfora and discord channels;

© The creation and assignment of discord and forum roles;

(d) Moderation of content posted to Caer Sidi’s communication platforms.

§2. Provide counsel to the Monarchy.



X. Taoiseach


Section A.

§1. The head of the Executive Branch shall be known as The Taoiseach.


Section B. The Responsibilities of the Taoiseach

§1. Any Citizen may be elected as the Taoiseach of Caer Sidi.

§2. The Taoiseach may appoint at their discretion a Tánaiste.

§3. The Taoiseach shall have the authority to create or remove positions in the Executive Branch as they see fit for their term.

§4. The Taoiseach shall be responsible for overseeing the daily activity of the region, and working with the Monarchy to encourage activity within the different aspects of the region.

§6. The Taoiseach shall be responsible, along with their Cabinet, for creating a quarterly update for the region. The quarterly update shall be distributed through all of Caer Sidi’s embassies.


Section C. Impeachment

§1. The Taoiseach may be removed from office at any time by the Monarchy or a majority vote of the Oireachtas. A new Taoiseach shall then be elected in a by election to finish the remainder of the term.

§2. Taoiseach who do not log into the forums for a period of 120 hours (5 days) without being on a Leave of Absence may besubject to impeachment.



XI. Tánaiste


Section A.

The deputy head of the Executive Branch shall be known as: The Tánaiste.


Section B. The Responsibilities of the Tánaiste

§1. Any Citizen may be appointed as the Tánaiste of Caer Sidi.

§2. The Tánaiste shall be responsible for assisting the Taoiseach in overseeing the daily activity of the region, and working with the Taoiseach, their Cabinet and the Monarchy to encourage activity within the different aspects of the region.


Section C. Impeachment

§1. The Tánaiste may be removed from office at any time by the Monarchy or a majority vote of the Oireachtas. A new Tánaiste shall then be appointed by the Taoiseach to finish the remainder of the term.

§2. Tánaistí who do not log into the forums for a period of 120 hours (5 days) without being on Leave of Absence may be subject to impeachment.



XII. The Oracle

The Oracle shall be the head of roleplay for Caer Sidi.

§1. The Oracle shall have the ability to accept or deny new roleplays.

§2. The Oracle shall be the main game master for the regional canon roleplay. They are tasked with keeping the roleplay alive and adding to the rich history and lore of Caer Sidi.

§3. The Oracle shall have the ability to create new subfora providing they are directly related to the roleplay of the region and are contained within ‘The Warrens of Aimsir’, ‘The Materium’, or in the Academy at Cora.



XIII. Clans


Section A. Clan Summer

Clan Summer shall be an autonomous political and cultural organization within Caer Sidi.

§1. Any citizen of Caer Sidi has the right to become a member of Clan Summer

§2. All members of Clan Summer are bound by the laws set forth in this constitution and may not create any clan law that overrides any regional law.

§3. Clan Summer shall elect a clan leader, known as the Luminary, for a term of three months. Repealed as of Luminary Term Length Amendment Act 2019, (29/12,2019)

§4. The Luminary may make changes to the structure of Clan Summer not covered within this constitution or established clan documents with a simple majority vote by the members of the clan.

§5. The Luminary is responsible for ensuring activity and ongoing events within the clan or delegating another clan member to do so.

§6. The Luminary is responsible for ensuring any appointed members fulfill their duties during the term.


Section B. Clan Winter

Clan Winter shall be an autonomous political and cultural organization within Caer Sidi.

§1. Any citizen of Caer Sidi may become a member of Clan Winter.

§2. All members of Clan Winter are bound by the laws set forth in this constitution and may not create any clan law that overrides any regional law.

§3. Each member of Clan Winter shall follow the Rule of Autonomy which states that no member of Clan Winter may exert authority over another member of Clan Winter in Clan related activities or operations without consent.

§4. The leader of Clan Winter shall be the Tempest, who may structure the Clan as they see fit during their term.

§5. The Tempest is responsible for ensuring activity and ongoing events within the clan or delegating another clan member to do so.


XIV. Elections


Section A. Election Procedure

Elections shall be called by the Monarchy or a member of the Interior Council.

§1. Elections shall last for a period of 48 hours after being called on the offsite forums.

§2. Votes shall be cast via poll in the Election Hall, with the declared winner being the candidate who receives the highest number of votes.


Section B. Runoffs

If two or more candidates are tied for the amount of votes in a general election, a runoff election shall occur.

§1. Runoff elections shall follow the same procedure as general elections with the exception of duration.

§2. A runoff election shall last for a period of 24 hours after being called on the offsite forums.


Section C. By-Elections

Should a candidate leave office before the scheduled term ends, a By-Election shall occur for that position.

§1. By-Elections shall follow the same procedure as general elections.

§2. A candidate elected in this manner shall finish the remainder of the original term.

§3. Should a member leave office with only 14 days left in term, a by-election will not trigger.


Section D. Election Schedule and Term Lengths

Elections shall be held on the following schedule.

§1a. Election schedules for the Taoiseach begin in December.

§1b. The Taoiseach shall have a term length of 2 months.

§2a. Clan Leaders and Orators shall serve until challenged via a public declaration of intent to run, or resignation of the office holder, triggering an election.

§2b Declaration to run must be made in either their respective subfora on the Caer Sidi Forum, or their respective channels in the Caer Sidi Discord server.

§2c. Those subfora and respective channels are;
(i) Orator: House Roayl, subforum or Discord channel;
(ii) Luminary: The Summer Coast, subforum or Discord channel;
(iii) Tempest: The Winter Grove, subforum or Discord channel.

§3a. Those standing or challenging for Orator, Luminary or Tempest must hold Citizenship.

§3b. Those running for Luminary or Tempest must;
(i) Luminary: Be a member of Clan Summer;
(ii) Tempest: Be a member of Clan Winter.



XV. Addenda


Section A. Majorities

§1. Simple majority shall be defined as more than 50%.

§2. Supermajority shall be defined as more than 60%.

(iii) Providing counsel to the Monarch during times of difficulty, and acting as a second in command on the administration team.

§3. Each member of Clan Winter shall follow the Rule of Autonomy which states that no member of Clan Winter may exert authority over another member of Clan Winter in Clan related activities or operations without consent.



§4. The leader of Clan Winter shall be the Tempest, who may structure the Clan as they see fit during their term.



§5. The Tempest is responsible for ensuring activity and ongoing events within the clan or delegating another clan member to do so.





XIV. Elections





Section A. Election Procedure



Elections shall be called by the Monarchy or a member of the Interior Council.



§1. Elections shall last for a period of 48 hours after being called on the offsite forums.



§2. Votes shall be cast via poll in the Election Hall, with the declared winner being the candidate who receives the highest number of votes.





Section B. Runoffs



If two or more candidates are tied for the amount of votes in a general election, a runoff election shall occur.



§1. Runoff elections shall follow the same procedure as general elections with the exception of duration.



§2. A runoff election shall last for a period of 24 hours after being called on the offsite forums.





Section C. By-Elections



Should a candidate leave office before the scheduled term ends, a By-Election shall occur for that position.



§1. By-Elections shall follow the same procedure as general elections.



§2. A candidate elected in this manner shall finish the remainder of the original term.



§3. Should a member leave office with only 14 days left in term, a by-election will not trigger.





Section D. Election Schedule and Term Lengths



Elections shall be held on the following schedule.



§1. All elected positions shall have a term of 3 months.



§2. Election schedules for Clan Leaders and the Orator begin in January.



§3. Election schedules for the Taoiseach begin in March.





XV. Addenda



Section A. Majorities



§1. Simple majority shall be defined as more than 50%.



§2. Supermajority shall be defined as more than 60%.

Term Length Amendment Act (2019)

NOTING that the time commitments required by the current term lengths is unreasonable and inaccesable to large portions of the citizenry.

INTENDING this act to shorten term length to be a more reasonable length to allow them to be more accessible to the citizenry.

Short Title:
(1) This act may be cited as the Term Length Amendment Act (2019)

Amendment:
(2) Section D. of article XIV. of the Constitution shall be amended as follows:

Quote:Section D. Election Schedule and Term Lengths

Elections shall be held on the following schedule.

§1a. Election schedules for the Taoiseach begin in December.

§1b. The Taoiseach shall have a term length of 2 months.

§2a. Clan Leaders and Orators shall serve until challenged via a public declaration of intent to run, or resignation of the office holder, triggering an election.

§2b Declaration to run must be made in either their respective subfora on the Caer Sidi Forum, or their respective channels in the Caer Sidi Discord server.

§2c. Those subfora and respective channels are;
(i) Orator: House Roayl, subforum or Discord channel;
(ii) Luminary: The Summer Coast, subforum or Discord channel;
(iii) Tempest: The Winter Grove, subforum or Discord channel.

§3a. Those standing or challenging for Orator, Luminary or Tempest must hold Citizenship.

§3b. Those running for Luminary or Tempest must;
(i) Luminary: Be a member of Clan Summer;
(ii) Tempest: Be a member of Clan Winter.

Enacture:
(3) This act shall come into force for each position following the position's next election

ACKNOWLEDGING the importance of restricting administrative powers to the Interior Council, yet
RECOGNIZING the possibility of granting the power of masking pre-approved usergroups without the need to possess any excess user group permissions,
Hereby amends, Schedule II, Section A, Clause 1 of The Constitution of Caer Sidi to the following
§1. A Regent may be appointed at the Monarchy’s discretion in order to provide support in governance.

Amends Schedule II, Section B, Clause 1 of The Constitution of Caer Sidi to the following
(i) Providing assistance in tasks such as new citizen acceptance and citizenship audits;
(ii) Providing counsel to the Monarch during times of difficulty.

Amends Schedule III, Section D, Clause 1 of The Constitution of Caer Sidi to the following
§1. The Taoiseach and the Monarchy shall have the ability to accept or deny citizenship and diplomatic applications.

Amends Schedule III, Section D, Clause 2 of The Constitution of Caer Sidi to the following
§2. The Foreign Affairs Minister shall have the right, along with the Taoiseach and Monarchy, to accept or deny diplomatic visas.

The Oireachtas Amendment Act (2020) passed by House Roayl on the Fifteenth of November 2020, in a vote of 4 ayes to 1 nay.
 

The Oireachtas Amendment Act (2020)

NOTING the absence of House Baile from the Constitution of Caer Sidi
INTENDING to correct this oversight and to clarify the role of each court and to stimulate roleplay in House Baile.

Hereby amends, Schedule IV, Section A of The Constitution of Caer Sidi to the following
§1. The Oireachtas shall be the legislative body of Caer Sidi.

§2. The Houses of the Oireachtas is shall be known as the House Roayl and the House Baile.

§3. The Oireachtas House Roayl shall be comprised of all citizens of the region. House Baile shall be comprised of representatives from each holdfast.

§4. The Oireachtas presiding officers shall will be led by know as the Orators.

§5. The Each Orator may at their discretion, appoint a Deputy Orator to help them in their duties.

Amends Schedule IV, Section B of The Constitution of Caer Sidi to the following
§1 The Oireachtas shall be responsible for drafting, debating and voting on legislative drafts, legal appointments under constitutional jurisdiction, and treaty ratifications.

§2 The jurisdiction of House Roayl extends to NationStates, metagame & metaroleplay matters, whilst the jurisdiction of House Baile extends to in character matters only. Non Roleplay or game matters are are exclusively handled by the administrative team.

§3 House Roayl shall be the superior house and the only House with the power to change the constitution of the region of Caer Sidi. This clause does not stop an in character constitution being established by House Baile for the purpose of roleplay.

§4 The Oireachtas shall not enact any law which contravenes this Constitution or any provision thereof, execpt where expressly permitted.

§5 Every law enacted by the Oireachtas which is in any  respect contravenes this Constitution shall be invalid.

Amends Schedule IV, Section C of The Constitution of Caer Sidi to the following
§1 Each House shall make its own rules and standing orders, with power to attach penalties for their infringement, and shall have power to ensure freedom of debate, to protect its official documents and the private papers of its members.

§2 All questions in each House shall, save as otherwise provided by this Constitution, be determined by a majority of the votes of the members present

Repeals Schedule IV, Section D of The Constitution of Caer Sidi

Amends Schedule VII, Section D of The Constitution of Caer Sidi to the following
VIII. The Orators of the Oireachtas

Section A. Duties of the Orators

§1. The Orators shall preside over the daily operations of the Oireachtas, ensuring that procedure is followed and any issue that arises may be dealt with fairly.

§6 §2. The Orator of each house shall have the power to table legislative proposals with a simple majority vote.

§7 §3. When appropriate; The Orator of each house shall make a monthly overview detailing current debates, vote counts, and updating the legislative agenda for the term.


Section B. Orator Elections.


§1. Each House of the Oireachtas shall elect from its members its own Orator and shall prescribe their powers and duties.

§2. The Orator of each house shall be elected from the voting members of the House by a simple majority.

§3. Orator elections in each house  shall last 48 hours.

§4. Should 48 hours pass without an election, the Monarchy shall appoint an orator from the voting members of the Oireachtas. the appropriate house.


§5 Both houses shall have the power to make their own provision for Orator elections, powers, and duties through law passed by that house. As such, §2-§4 of this section of this article may be overridden by standing orders or acts of the relevant house.

§6 The Orator or presiding member shall have and exercise a casting vote in the case of an equality of votes.


Section C. Impeachment

The Orator shall be held accountable as a representative of Caer Sidi.

§1. Any Orator who does not log into the forums for a period of 7 days without being on Leave of Absence may be subject to impeachment.
